5. Magician Jeff McBride And His Clone

Losander
is known as "the Master of Levitation." In the
most famous part of his act, a table floats impossibly,
darting around as if possessed.
It's
not just his signature illusion, it's his magical legacy.
Losander sells his floating tables to magicians around the
world. And they can cost thousands of dollars. At least,
that was until a knock-off started appearing on Chinese
websites.
At
the beginning when these copies popped up like mushrooms,
I got very upset," Losander says. "They even sell
cheaper than I can buy the materials. You can sell a floating
table for $30," he adds with a laugh.
Losander
says the cheap copies don't work, but the websites would
have you believe you're buying the original product. In
fact, one of them displays pictures of Losander's own tables;
it even embeds Losander's promotional video.
The
website 52magic.com isn't put off by the fact that the video
has a text disclaimer warning about copies.
"It's
a sad situation, it's like a cancer in our business,"
says Kevin James, another magician, world-famous for his
innovations- so much so, he's been nicknamed 'the inventor.'
And
some of his best inventions are popping up on counterfeit
sites, for instance, his "Snow Animator"- a device
that produces a snowstorm of confetti from the magician's
hands. James says the problem is compounded by online retailers
outside of China.
"What
they'll do, this bad dealer in France will take photos,
and text off china website, translate it to French, so if
you're a young magician in France, you go to this website
and you'll go and see Kevin James snow animator, right?
and the text says something very ambiguous, like "when
Kevin performs this he gets a great reaction," James
says.
Big
media corporations have staked out some strong protection
for intellectual property, but for the individual magician,
protecting ideas is tricky.
There's
a lot of legal ambiguity, according to Sara Crasson, an
intellectual property lawyer and magician herself.
"If
someone can watch the performance and figure out what the
secret is, then that magician would lose trade secret protection,"
says Crasson. "For magicians, trade secrets are a lot
tougher to keep because magicians frequently do know how
other magicians do their work; it's a much more complicated
thing for magicians to do."
Okay,
forget about the trick. What about just patenting the device?
"Magicians
rarely actually patent devices they invent," says Crasson.
"Horace Goldin is an example of why magicians don't
do it."
Goldin
performed the 'sawing a lady in half' illusion in the 1920s,
before it turned into a cliché. He patented the box
he used-then was horrified to see the secret revealed in
a series of ads for Camel cigarettes, with the slogan, "It's
fun to be fooled, it's more fun to know."
Goldin
sued.
"The
court denied his claim, and said that when Goldin had patented
the illusion, he had abandoned the information to the public
and so couldn't claim this was a secret, or blame anybody
for talking about it," Crasson says.
Then
there's the issue of enforcement; Kevin James patented a
gimmick that makes it look like the performer is carrying
around a squirming, amputated arm. But James says his patent
didn't keep knock-offs from appearing on the market almost
immediately.
"I
went to an attorney-he said 'well, okay, I need $30,000
just to start. I can't do it on a contingency basis- it's
not like a microchip, there's no pot of gold at the end
of this rainbow,'" James says.
James
finds it so frustrating, he's going to stop marketing his
tricks. "Your patent is only as good as your ability
to enforce it," he says. "Now it comes down to
ethics, if we can somehow educate magicians on what is the
ethical thing to do, that is probably our best bet."
Sometimes,
that education has to happen one magician at a time. Jeff
McBride is one of the most accomplished magicians in the
world. His most famous routine - and you have to check out
the video to appreciate it - involves an intricate series
of transformations with a variety of masks.
So
you can imagine McBride's astonishment when he saw a YouTube
clip of a magician in Thailand performing his entire routine,
move for move, even using Jeff's original music.
"It
is not a just a duplication of one of my tricks," he
says, still amazed. "It's not just an exact copy of
one of my routines; it's my show, my entire show
and
the kabuki part, the mask production part
the guy
cut and dyed his hair like me, and it was the most carbon
copy sort of duplication I have ever seen. Before I had
seen magic acts copy little bits or be influenced by my
style, or a trick here or a trick there, but this was the
whole enchilada."
Fans
were calling for the Thai magician's head, but McBride,
who runs a magic school in Las Vegas, saw a teaching opportunity.
With the help of Google translate, McBride started a dialogue
with the magician, who goes by the name Pat Bozo.
"It
seemed like he was doing a tribute act like someone would
do a Beatles, or a Pink Floyd, or a Black Sabbath tribute
act," says McBride. "He wanted to do it exactly
like that. And I could obviously see that. So I didn't want
to slam the guy, but what he was doing wasn't right- and
he's on television doing it."
McBride
explained that sort of copying wasn't acceptable in the
magic community. He says Bozo felt terrible.
"And
now he knows that people have issues with that. And it's
time for him, now that he's had this experience, to come
up with some original magic, and I'll even help him. That's
fine, that's my job as a teacher."
McBride
says Bozo took the video down. Beyond that, he's encouraged
by another development from the East: In South Korea, which
is experiencing a magic renaissance, professional magicians
have started an awareness campaign called "Do Not Copy
the Magic."

The Mystery Lounge.
Last
Tuesday I had the great pleasure of appearing at the Mystery
Lounge in Boston. This was only the second time in the 19
years the Lounge has been around that I got to participate
in the fun. I wish all the gigs I do were as big a blast
as this one! It was fun with a capitol F.
First
you make your way to the Hong Kong café located at
1238 Mass Avenue in Harvard Square. After walking up three
flights of stairs you arrive in The Mystery Lounge, if it
is a Tuesday night. The rest of the week you would be in
The Comedy Studio--- a very popular local comedy venue.
That is when things kick into gear.
The
showroom is a cozy performance space with a small stage
situated across one of the corners of the room. There is
friendly bar service from the cocktail waitresses, who will
also bring you menus and deliver your choice of delicious
(and very reasonable) Chinese food.
The
venue offers low-key, but effective tech for its performers,
which is run by the charming Andrea Hogan-McAlpin. Much
to my surprise after my performance she handed me a DVD
of my show that had been taped from the booth. This was
a very nice touch and is a real benefit to magicians performing
who wish to try out new material.
It
was Halloween week when I was featured in the Lounge and
we had a special surprise on the bill in the personage of
Dr. Magogo. It was a delight to watch the droll performance
by the good Dr. who performed some classic effects with
quirky props that looked like antiques! In fact, nicely
layered with sight gags, the Dr. performed a couple of effects
that I had only previously seen in magic catalogues. Dr.
Magogo is a regular Halloween guest at the Lounge and his
performance was obviously highly anticipated by the audience,
he performed two segments in the show and received a great
ovation from the audience. I enjoyed both sets enormously.
I
know very little about Dr. Magogo but with his whitened
face, razor thin mustache and bright red fez it reminded
me of the bills I shared in the '70s with my old friend
Johnny Platt. I believe the Dr. must be a good friend of
the mega talented Mike Bent as they arrived together. Sadly
I didn't see anything more of Mike during the remainder
of the evening; which is a shame as he is one of my very
favorite comedy magicians.
The
next performer to hit the boards was another local favorite
Joe Howard. Joe, wearing his trademark bowler hat, performed
a fast and funny act that was perfectly honed and presented.
The laughs came thick and fast but never at the expense
of the great magic he wowed the crowd with. Joe's versions
of Chase The Ace and Cups and Balls are definitive in their
ability to remain visual in a showroom setting. Joe is expert
at bringing the energy of street magic into a formal environment.
The crowd roared their approval!
A
comedian from the Comedy Studio mixed up things on the bill
with a short set of pure stand-up comedy. Sadly I didn't
get to catch his set, as I was busy in the dressing room
setting up my props for my performance. The addition of
this blast of non-magic comedy is something that adds significantly
to the appeal of the Mystery Lounge.
I
then got to perform a 45-minute set of my favorite pieces
of comedy and magic to the delightfully appreciative audience.
With so many friends and colleagues out front, including
fellow performers Robert Fellows and David Oliver, it was
a truly joyous experience to bring my magic to Harvard Square
again. I am counting the minutes till my next visit. If

Convention in Liverpool, England from 14-16 July next year

13. Paul Daniels Article About David Hemingway's DVD

It
was nice to read Paul Daniels article about David Hemingway's
DVD, 'The Magic Fly on the Wall' a couple of weeks ago in
Magic New Zealand.
I have always been a fan of David's and I have a great deal
of respect for him. Sadly, I suspect that many of the people
in today's magic world have never even heard of David Hemingway.
I
met David over 40 years ago when I was booked for my first
summer season in Blackpool and I was impressed with his
knowledge of the magic business and what was needed to be
successful as a performer.
David
has never been one to sing his own praises, although he
is the consummate professional and has done pretty much
all there is to do in this business, as a performer, director,
magic consultant, and illusion builder.
His
non PC observations have on occasions upset the establishment
simply because he speaks his mind and tells it like it is.
He is invariably right.
I
found his two DVD's, 'The Magic Fly on the Wall' and 'The
Best of an audience against David Hemingway' to be hugely
entertaining and a rare treat. David is extremely articulate,
his stories wonderful and his delivery and timing are a
lesson to any aspiring performer. These DVD's show David
at his best, at times confrontational and always direct,
and it was good to see my longtime friend Don Bevan in fine
form as moderator, attempting to keep David on track. Not
an easy task.
I
haven't enjoyed any magic DVD's this much for years, it
took me back to the good old days of Ken Brooke, Fred Kaps
and so many more magic greats. Bravo David, and thanks to
International Magic for producing them.

FISM European Championships in 2017

Magicians Club have once again been chosen to host the FISM
European Championships In 2017 at the Winter Gardens, Blackpool.
The BMC successfully launched the very first FISM European
Championships in 2011 and we are delighted to have been
chosen once again.

in the recovery of Simon Lovell's health.

Blackpool
Magicians Club Ltd., are delighted to announce that they
are in the process of purchasing their own super premises
in the centre of Blackpool. Over the next few months the
building will be transformed into a Magic Theatre, a Magic
Library, a Magic Shop, a Magic Museum, a Close-Up Room,
a Committee Room, a Television/Video Room, a Catering Facility
and a Bar Area. Apart from hosting Lectures by international
magicians, a School of Magic will be created along with
other innovations.
Buying
this building represents a major investment in the future
of Blackpool Magicians Club and the Blackpool Magicians
Convention and it is hoped that many of our registrants
will be able to visit the headquarters in the future.
