6. Open Letter To Mark Kalin Of The Illusionists Produced By Simon Painter

I was shocked yesterday when I saw your name displayed first disclosure of expert witnesses willing to testify against me in Simon Painter's Federal lawsuit to oppose my trademark application for the name of my show, The Naked Magicians. Thus far, my legal expenses have reached nearly $30,000 to protect my creation. Simon Painter has attempted to acquire the name of my show, The Naked Magicians, by any means available to him, except actually calling, asking, and paying for the rights to use it. I am disappointed that you are willing to sell your artistic integrity to the producer providing you the most work.

You were one of the first people I reached out to when I discovered that Simon Painter was using the name The Naked Magicians for a show involving two Australian magicians stripping nude and doing pornographic themed hack magic. Simon never contacted me in any way to discuss an ethical or professional arrangement. I contacted you because I believed you understood the professional ethics and morals that our magic community relies on to protect magicians and their creations.

I also knew that although it is not technically illegal to copy your Fire Spiker and many have, there is a code of ethics that the professionals of our industry follow. Those professionals have paid rights to you with absolutely no legal obligation to do so. They merely respect the art and its creators.

You told me to contact Simon and provided an e-mail. I got in touch and spoke with him on the phone. He was condescending and rude and insisted that I have no right to the name and he was willing to fight me to take it. He offered no amount of money to purchase rights or maintain goodwill in this situation. This behavior was not very becoming of someone who goes to great lengths to hire performers with original illusions and creative talents.

My show, The Naked Magicians, was meant to focus on the performance pure sleight of hand artistry and stage manipulation. It was created and developed in 2006 in my own close-up magic shows on cruise lines around the world and expanded to include more magicians and a hostess in a theater setting.

I created The Naked Magicians to honor fellow magician, Chappy Brazil, who worked with you and me at Caesar's Magical Empire. As you know, he was killed in an accident during the run of that show and this creation was my way of honoring him. That is what our magic community is about. Respect of others and the creative people that pave the way for our art.

Simon Painter hides behind a company known as Asia Live Network and as such has been able to keep his name from being associated with this unethical behavior. His limited experience in magic does not allow him to understand the professional and ethical conduct that most working magicians regard.

I'm pleased to see that not one of the other magicians involved in The Illusionists was willing to be bullied into testifying against a friend in magic or fellow creator. Thank you Dan Sperry, Kevin James, Luis DeMatos, and all the others for your strength in stepping aside from this dispute.

As the lead expert witness for Simon Painter and Asia Live Network, you can use your expertise to encourage them to cover my legal costs and maintain goodwill by making a professional arrangement to use the name for their show.

We must rely on honesty and integrity of the magic community.

Yours is the most unkindest cut of all.

9. Snowing In September? Now That's Magic

Filling a theatre stage with a snowstorm this September was just one magic trick which won South Croydon magician Gordon Drayson the trophy in the Kidology UK Children's Entertainer of the Year Competition held in Wolverhampton on the 8th September.

Winning a trophy and automatic entry to the UK Children's Entertainer Of The Year competition to be held at the Blackpool Magic Convention in February 2016, Gordon performed his act, specially created for the event, to about 25 children and 100 other children's entertainers.

Votes were cast by the adults in the audience, so to be voted best by his fellow entertainers is a great accolade. Gordon said "I was surprised and pleased to win this competition and now have to prepare my act to perform in Blackpool, in the Winter Gardens Opera House, which has a capacity of nearly 3000 people and is one of the biggest in Europe, so no pressure there!"

His act for the Kidology Competition took his audience back to their childhood, asking the important question "Do you believe in magic?" and featured a talking drawing board and the snowstorm that filled the stage.

The 24nd Annual New England Gathering of the Magi takes place this year on November 12, 13, 14, 2015 at The Crowne Plaza in Southbury, CT.
