Left Him Stranded in Venezuela
After
escaping the country, Brett Daniels now says he's due royalties
by contract and damages for copyright infringing illusions.
Professional
magician Brett Daniels says he has a trick to make vehicles
like an antique horse and carriage appear out of thin air,
but needed to resort to legal threats in order to get out
of Venezuela.
Daniels
is the co-creator of The Illusionists, reported to be the
highest selling magic show in Broadway history and possibly
soon to be showcased in a television broadcast.
In
his complaint filed in Wisconsin against other Illusionists
producers including Simon Painter and Timothy Lawson, Daniels
alleges he was due 10 percent of all fees paid to performers
for any Illusionists show in any format.
"However,
after using Daniels' expertise, contacts, and efforts to
get the show off the ground, and after the Show began to
achieve international success, Defendants cut Daniels out
of the Show and refused to pay him his contractually guaranteed
share of the Total Act Fees from at least November 2013
to the present," states the complaint. "Further,
Defendants continue to use Daniels' proprietary copyrighted
illusions in the Show without Daniels' approval or consent."
Daniels
says he invented his vehicle appearance illusion in 1993,
has registered choreography and stage direction with the
U.S. Copyright Office, and helped lead efforts to create
an ensemble magic show that is now performing worldwide.
His 10 percent share was first orally agreed to, and according
to the lawsuit, later confirmed in writing. As The Illusionists
garnered commercial success, Daniels says he set up several
meetings in Hollywood, introducing Painter to a well-known
TV executive, and that an agreement was made that would
entitle him to 25 percent of revenue from a TV special.
In
May 2013, he adds, he was told by defendants there was "a
very good chance that the Illusionists TV show is going
to be bought by a major network."
That
summer, The Illusionists was due to do a South America tour.
That's where the craziness allegedly starts happening.
"Specifically,
in July of 2013, Defendants insisted that Daniels and the
performers in the Show travel to Venezuela for a final set
of performances after what was supposed to be the end of
the South American tour in Brazil, despite Venezuela being
a non-contracted location which was never agreed upon prior
to the start of the tour," says the complaint. "Defendants'
insistence on such performances of the Show was unreasonable,
as Venezuela was an extremely unstable environment for the
production of the Show."
Daniels
says the performance never occurred.
"Instead,
the Venezuelan government seized the Show, the venue, and
all of its stage equipment prior to the Show's first performance
and was holding all such assets under armed guard. This
included Daniels' equipment, which was the largest, most
intricate, and most valuable of any other performer in the
Show."
Daniels
says the defendants "plotted" to send everyone
in the cast home from Venezuela. But not him. He was left
"to fend for himself against the Venezuelan authorities.
Defendants did not even provide Daniels with access to food,
water, or medical care for his severe illness during his
remaining time in Venezuela."
Five
days of being stranded in Venezuela proceeded where Daniels
allegedly couldn't get his fellow partners to get him out
of the country.
"Only
after Daniels threatened legal action against Defendants
did Defendants finally agree to provide Daniels with a plane
ticket out of Venezuela," continues the complaint.
"At that point, however, Daniels began to realize that
Defendants were likely plotting to remove him entirely from
the Illusionists."
In
a lawsuit which under normal circumstances would gather
interest with regards to intellectual property assertions
over magic instead there's talk about "death threats"
made and a "ruse to delegitimize" Daniels claims.
The lawsuit suggests that authorities have been contacted.
Nevertheless,
this is still a lawsuit about money where Daniels objects
to how he was pushed out of the show, how his illusions
were allegedly misappropriated, and how he's no longer getting
his full 10 percent. Plus, there's royalties from a possible
TV show at stake. Here's the full insane lawsuit alleging
breaches of contracts, unjust enrichment, conversion, copyright
infringement, trade secret misappropriation and breach of
fiduciary duty. Daniels is represented by Gregory Ostfeld
and Tyler Andrews at Greenberg Traurig.
The
defendants couldn't be reached for contact, but we'll update
if we hear anything from them.

Have
you ever had a situation where you are at a birthday party
gig and you have the kids all seated and engaged in the
show. It is going great and all of a sudden the doorbell
rings and in comes Aunt Betsy.
Aunt
Betsy is excited and so immediately runs into the room and
proceeds to give the birthday child a gift oblivious to
the fact that you are already into your show. She forces
the child to open the gift right then and there.
You
are left in a very awkward situation. Now this may seem
like a very crazy and extreme situation, but it does happen
and it happens in various degrees. You are in a house that
they are accustomed to being at. They tend to feel that
this is their environment and that you are just a part of
the overall fun happening. They tend to not see an issue
with interrupting the flow of the show.
So
how do you handle this? How do you go about trying to gain
control back and getting back into the show when a situation
like this unfolds?
The
kids all lose focus, they get involved in the present and
you are left with a situation of standing there lost and
trying to regain control. Part of you wants to latch out
at the rude individual but as a professional, you should
know that is certainly not an avenue you want to go down.
Certainly you do not want to go there with children present.
So
my options are to get rude and make a statement to the person
or choose to somehow maintain control of the situation and
maintain the focus back on me.
I
tend to allow the situation to happen because to try and
stop it cold turkey just leaves a bad taste in everyone's
mouth. It also is hard to get them to stop in the first
place and you tend to not be able to do it without being
rude and harsh.
Instead
I choose to be the center of attention. By that I mean that
I allow myself to become a part of it. To just stand there
and watch it happen and say nothing, gets folks to not pay
any attention to you at all. However, if you start to become
a part of the situation as it unfolds the focus is left
on you and you still look like the good guy.
So
what I tend to do is to talk up and act as an MC of sorts.
I am the one conducting the situation. As I start to talk,
people listen and I am in control of what happens. It many
ways I can direct it and steer it in any direction I want
it to go in. I can be funny, deliver comedy lines and be
excited about it as well. If handled right, I can get everyone
seeing me as a good guy, I gain control and I have it over
a lot faster.
I
might state that I am excited that she finally showed up.
I might say that we were waiting for her since we are having
SOOO much fun during the show and are sure that she will
as well. I might joke that the gift was for me and thank
her a lot for such a wonderful gift for the magician. By
doing so it becomes a part of the show itself. I can get
laughs but I am also subtlety letting her know the show
is taking place. I am doing so in a kind manner though.
I
may go on to complement such a nice gift and the paper is
so nice. I might suggest the child thanking the aunt and
to pass the card and gift to mom and dad so they can make
sure it doesn't get broken. I them can segue back into the
show at a faster pace.
So
as you can see this is never an ideal situation, but it
is one in which you can choose to remain in control. I feel
and act as if it was just another routine in my show. By
me speaking up and handling it as I do, it often goes over
just fine, the person gets the message clearly and I keep
the distraction to a minimum.
The
worse you can do is just stand there and allow it to happen
without saying anything. Then you become invisible and often
times it is impossible to get back into the performance.
Your momentum is killed and the flow of the show is shot.
I
am never there at a gig to be the bad guy. My goal is not
to upset people

7. Magician Impales Hand On Huge Nail

goes massively wrong
A
magician performing a Russian Roulette-style trick managed
to impale his hand on a six-inch nail after it went badly
wrong.
Kyle
Wallace was performing at the Arch 1 theatre in West Ham,
east London last week.
During the show he tried to perform a trick where an upright
nail poking through block of wood is placed in a bag, and
three identical bags which have items of a similar size
within them are swapped around.
The
audience is then invited to choose which bag the daring
magician slams his hands on.
However during the performance the 55-year-old showman hit
the wrong bag.
The
six-inch nail was left stuck in his palm.
He
told the London Evening Standard: "As I raised my hand
I brought the bag up with it. It was a nightmare

8. The Magic Word Podcast - A Chat With Shoot Ogawa

Near
the turn of this century, there was a near-cataclysmic eruption
on the west coast as Shoot Ogawa moved from Japan to Los
Angeles. He turned the heads and got the attention of many
occidental magicians by introducing the Muscle Pass and
(perhaps more notably) the Ninja Rings. Although he was
still learning English, he was able to win Close-Up Magician
of the Year in both 2003 and 2006 from the Academy of Magical
Arts (AMA). Two years later, he was presented the Parlour
Magician of the Year by the AMA. He was featured on the
cover of MAGIC Magazine in 2003 and continues to this day
as one of the most recognized and revered proponents of
magic.
This
week on The Magic Word Podcast, Shoot talks about his formative
years in Japan working as a demonstrator in a magic shop
and how he came to move to the U.S. Shoot Ogawa tours the
world performing and consulting so it was wonderful that
he had time to spend time to chat during his abbreviated
lecture tour that brought him through Houston, Texas.

announces their 2015 entertainment lineup. The musical performances
will be featured on two separate stages during the parade
and national telecast, and will include the following artists:

Alexander Jean featuring B.C. Jean and Mark Ballas; Sean
Kingston; Heather Russell; Ruben Studdard; and Ace Young.
Performances will feature the Marine Toys for Tots program,
which is essential in providing gifts to less fortunate
children everywhere.
In addition to the musical performances, a "Magic of
Christmas!" segment from the magicians appearing on
the hit TV series Masters of Illusion will also take place.
A special salute to American soaps will also be featured
with appearances by General Hospital's Rick Hearst, Emme
Rylan and Bradford Anderson; The Young & Restless' Tristan
Rogers, Kate Linder, Bryton James and Christel Khalil; The
Bold & The Beautiful's Scott Clifton and Jacqueline
Macinnes Wood; and Days Of Our Lives' Martha Madison, Deidre
Hall and Galen Gering.
Penn & Teller, stars of the hit CW series Penn &
Teller: Fool Us, will be the Grand Marshals for this year's
parade. Presented and produced by Associated Television
International, the live event, taped for network television,
will take place on Hollywood Boulevard on Sunday, November
29 at 5:00 p.m. This year the parade will honor Oscar de
la Hoya with the "Humanitarian Award" for his
outstanding charity work over the years. Deidre Hall will
make a special presentation to Marine Toys For Tots. The
parade and television broadcast will be co-hosted by popular
television personalities Erik Estrada, Laura McKenzie, Dean
Cain, Montel Williams, with special co-hosts Elizabeth Stanton
and Garrett Clayton.
The 84th Annual Hollywood Christmas Parade will premiere
as a two-hour special on The CW Network on Friday, December
11 at 8:00 p.m. Eastern and Pacific/7:00 p.m. Central. Long-time
parade partner Hallmark Channel will air multiple runs beginning
Saturday, December 19 on their Hallmark Movies & Mysteries
channel. The parade will also air to more than one million
American servicemen and women worldwide on American Forces
Network. Media partners for this year's parade include Entertainment
Tonight, The Insider, Variety, KTLA, Radio Disney, Hallmark
Channel and KOST 103.5 FM.
Grand
Marshals Penn & Teller, world acclaimed magicians and
entertainers, have been performing as a duo together for
the last four decades, combining magic with comedy. Headlining
in Las Vegas at The Penn & Teller Theatre at The Rio
Hotel, the two are currently starring in the Penn &
Teller: Fool Us series produced by 1/17 Productions and
airing on The CW Network, and have also been featured in
numerous stage and television shows.
A true Hollywood tradition, this year's parade includes
over 4,000 participants and attracts more than one million
in attendance each year, with larger than life inflatable

The Nebuta Float is making its debut in the parade this
year, and is inspired by the popular Nebuta Festival of
Aomori Prefecture, one of the largest and most famous festivals
in all of Japan that dates back hundreds of years. The Nebuta
Float was designed by Japanese Masters Artist, Hiroo Takenami,
specifically to be showcased here in Los Angeles. Its colorful
design is carefully hand-painted and constructed of traditional
washi paper and outfitted with over 3,000 LED lights. This
year's float depicts the "Legends of Yoshitsune,"
the story of the celebrated General of the Minamoto clan,
Minamoto no Yoshitsune, who by divine power safely travels
across the ocean for battle.
The parade will also include the U.S. Air Force Color Guard,
Mini Jets and a P51 Mustang Plane, a Falan Dafa float (the
traditional Chinese self-cultivation practice - Azusa, CA),

12. FCM Announces 2016 Convention Info

The
Fellowship of Christian Magicians (FCM) has announced details
for its 2016 International Convention. It will move back
to July (25-29), so mark your calendars. It will still be
in Nashville, Tennessee, and on the campus of Trevecca University,
as it was this year. But next year it will be held entirely
within the spacious Trevecca Community Church on the campus.
The theme for 2016 will be: "A Year of Second Chances,"
based on the Biblical verse 2 Corinthians 5:17.
The
emphasis throughout the five days of the convention is learning,
teaching, and sharing the performing arts of magic, clowns,
ventriloquism, juggling, puppets, face painting, balloons,
and drama/story-telling/chalk art. Of course the emphasis
is on applying each of these to spreading the gospel. There
are workshops, nightly shows, hospital visits, inspirational
talks, exhibitors, and even a flea market and an auction
to sell your unwanted things and stuff.

13. Roberto Giobbi Coming To Belfast MagiCon 2016

with The Ulster Society of Magicians will be hosting the
next International Brotherhood of Magicians, Ring 85, Irish
Magic Convention 2016.
They
are delighted to tell you all that Belfast's headliner for
the weekend will be non-other than Roberto Giobbi who will
be performing, lecturing and providing many other little
surprises that weekend for conventioneers. Over the course
of the Bank holiday weekend, Friday 29th April, Saturday
30th April and Sunday 1st May 2016, they will host a range
of local and top international acts in which, hopefully
will be an exciting and intimate convention held in the
heart of Belfast's most happening district, the Cathedral
Quarter.

will be lecturers, dealers, performances from world class
circus acts too plus public shows on Friday Evening, Saturday
afternoon and the Gala showcase on the Sunday evening. You

months ago The Society of American Magicians quietly launched
a new service to help point magicians around the world towards
the very best online content dealing with the Art of Magic.
That service is called The Magic Compass.
Initially
The Magic Compass was conceived as a newsletter styled email
that would point readers toward magic's best viral videos,
top news stories, exclusive offers, contests, polls, tricks
and more. People can sign up for that newsletter at http://goo.gl/5LnzN9.
The S.A.M. even produced a video to explain the idea that

As
The S.A.M. was developing this service the need for an anchoring
website became apparent and that is why The Magic Compass
is also a website that is regularly updated with the latest
online magic information. That website can be found at http://www.magic-compass.com.
Since
being launched, The Magic Compass has already delivered
news to thousands of readers. This week alone The Compass
has directed viewers to videos and posts of magician Nathan
J. Roberts making a little girl's parents reappear after
being deployed overseas, Justin Flom's Mega-Mix, Penn &
Teller's appearance on The Tonight Show starring Jimmy Fallon
and a Young and Strange magic Prank in England.
After
quietly launching The Magic Compass, The S.A.M. is now ready
for a full roll out. This service is not just for members
of The Society of American Magicians but for anyone with
